Step 6: Acceptance of terms

1. These Terms and Conditions form part of the credit agreement between Taylor Marketing (Ely) Ltd trading as Buffaloan (us, we, our) and You (you, your). You should only accept these terms and conditions if you wish to be legally bound by them. 
2. To improve efficiency, the credit agreement and all other communication between the parties (you and us) are, unless otherwise stated, to be provided by way of electronic means. These are principally email, our website or the telephone. You should follow the instructions for entering into the agreement which you will do by the means of an electronic signature (typing your surname when asked). The agreement only comes into force when you have signed electronically. We will send you an email or other electronic communication to notify you when the agreement comes into force. 
3. The amount of credit shown on the agreement will be paid directly into your bank account by electronic transfer. By signing the credit agreement you agree to: 
3.1. Receive all communications from us and to send all communications to us, unless otherwise stated, by electronic mail at the email addresses notified. 
3.2. Notify us immediately in the event that you: 
3.2.1. Change your email address, in which case you agree to provide us with your new email address; or 
3.2.2. No longer have an email address or have no means of receiving any electronic mail from us. 
4. If we make an 'offer in principle' then this will be dependant on further checks being carried out and the results obtained. Buffaloan may choose to offer to lend you a different amount based on information provided or obtained about you in line with our lending criteria. 
4.1. If a lesser amount is offered you will be given the option of whether to accept this amount or decline the loan. If you accept then a new loan agreement will be produced. You will not be asked to re-sign this new agreement but by accepting the revised offer you agree to us transferring your electronic signature to the new agreement. 
4.2. If we decide we could offer you a higher amount than you asked for you will have the option of extending your credit up to this amount by entering the new amount of borrowing and accepting the loan. You will not be asked to re-sign this new agreement but by accepting the revised offer you agree to us transferring your electronic signature to the new agreement. You should be advised that by borrowing more the charges incurred will increase. 
5. If we suspect or discover that any information given to us which forms part of the credit agreement or the decision to offer credit, is incorrect or fraudulent before funds are advanced to you we may, at our total discretion, void the loan agreement or make a lower offer of advance.
6. If we decide to lower the amount offered or we choose to void a loan we do not have to give a reason for this decision. All decisions to offer finance are at our total discretion.
7. We will not be liable in any way for any cost, whether financial or otherwise, or any inconvenience caused directly or indirectly by funds not being advanced to you. For your protection we advise that you do not commit any loan finance until it arrives in your nominated bank account. 
8. You agree to pay to us the total amount payable by the date shown on the loan agreement by the debit card given at the application stage.
9. You confirm that the debit card detailed in 8 above is for the same account that your salary or wages is paid into.
10. All sums owed under the agreement shall become due and payable immediately upon us giving notice if:
10.1. Any sum due is overdue by more than 3 days; or
10.2. You have provided us with any false information when you entered into this agreement; or
10.3. A statutory demand is served on you or any other steps are taken by you or any other person to make you bankrupt.
11. Interest on any overdue amounts will be charged at 30% per 30 day period or part thereof, commencing the day after payment became due under the credit agreement, until the day your account is settled in full (including both before and after any judgment has been obtained against you). 
12. You authorise us to collect any monies owed under the Agreement from any debit card account of which you have supplied details to us. We may make these attempts as frequently and at any time we choose while there is an overdue balance on your loan account, up until the time where the total amount collected equals the total amount owed. At this stage it will be deemed that your loan has been fully repaid. We do not have to give notice of these intended collection attempts.
13. The information that you have provided in this Agreement will be used by Buffaloan to enable Buffaloan to lend you the Loan. We will not pass your information to any third party without your consent. However, in the event that You default in your repayment of the Loan, or we believe that false information has been supplied, we shall revert to your employer and any other relevant parties in order to recover any sum including interest for the outstanding Loan or confirm that you are in fact employed by the Employer you claim to be employed by. If you wish to benefit from the loan, you will be required to provide Buffaloan with consent to contact your employer and any other relevant third parties in order to secure repayment of the Loan. If you do not wish Buffaloan to contact your employer, then Buffaloan cannot advance a Loan.
I confirm that I provide Buffaloan with consent to contact my existing employer as is required in order to arrange for the repayment of the Loan at a rate of no more than 10% (ten percent) of my monthly or weekly wage and I hereby consent to Buffaloan making disclosure of the Loan to my Employer on my behalf.
14. We may use credit reference and fraud prevention agencies to help us make lending decisions. 
15. You have a right to cancel the credit agreement within 14 days commencing on the day after the agreement comes into force. If you wish to cancel the credit agreement you can do so by the following means:
1. By sending a notice to us in writing at Taylor Marketing Ltd, t/as Buffaloan PO Box ELY CB7 9EQ. If you send a notice by post, then your notice will be taken to have been given on the day it was posted.

16. If you decide to cancel the credit agreement you will have to repay to us as soon as possible, and in any event within a period not exceeding 5 days from the day when you exercise your right to cancel in 14 above:
1. The amount of credit stated in the credit agreement, plus
2. A cancellation administration fee of ?25. 
17. You must inform us in writing within 5 days of any change in name, home address, email address, job or any other circumstances relating to your ability to discharge your liabilities under this Agreement.
18. If we decide to transfer or sell all or part of a debt to a third party they will have the same rights in respect of recovering the debt as we have under the loan agreement and Consumer Credit Act. The third party will then assume the role of Creditor in the agreement. References to we and our within these terms and conditions will be conveyed to the third party concerned. 
19. We are licensed by the Office of Fair Trading of Fleetbank House, 2-6 Salisbury Square, London EC4Y 8JX. Our consumer credit licence number is 576083.
20. We operate a complaints procedure in the event that you are dissatisfied with any aspect of the service we provide. Full details are available upon request or from our website www.buffaloan.co.uk. If any complaint you make is not resolved to your satisfaction then you may also be able to refer your complaint to the Financial Ombudsman Service, South Quay Plaza, 183 Marsh Wall, London, E14 9SR.
21. All terms and conditions, correspondence and any communication from us will be in English.
22. You should be aware of the possibility that other taxes or costs may exist in addition to the sums referred to in the credit agreement which are not a condition of the loan or imposed by us.
23. This agreement is governed by English Law. 
24. All information given by you to us, along with information we obtain from third parties are stored and processed in accordance with our Privacy Policy. This privacy policy forms part of our terms and conditions and therefore by accepting these terms and conditions you also agree to accept the terms of the privacy policy.
25. Each item in these terms and conditions and the loan agreement is an exclusive clause. If any clause is challenged in a court of law and found to be unenforceable all other clauses will remain legally binding.
26. Buffaloan will take  £5.00 or £10.00 application service charge  to process your loan application.  This is a one off non-refundable payment.

	I agree that should I enter a Debt Management Programme or IVA, within 31 days of taking this loan, or before this loan is repaid, that the initial loan and subsequent interest will be repaid immediately and in full and all monies owed to Buffaloan, or its appointed agents, falls outside of the Debt Management / IVA programme.
